Furs4Sale — Terms of Service

PLEASE READ CAREFULLY. Section 17 contains a binding arbitration agreement and class-action waiver that affect how disputes between you and us are resolved. You may opt out of arbitration within 30 days (Section 17.6).

These Terms of Service ("Terms") are a binding agreement between you and TJB Partners LLC ("Furs4Sale," "we," "us," or "our"), a Minnesota limited liability company located at 858 140th Ave, Fairmont, MN 56031-1338, USA. They govern your access to and use of the Furs4Sale website, marketplace, and related services (the "Service").

By creating an account, listing an item, making a purchase, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.


1. Eligibility & accounts

1.1 Age. You must be at least 18 years old and able to form a binding contract to use the Service. The Service is not directed to children.

1.2 Registration. You agree to provide accurate, current information and to keep it updated. You may register using an email and password or a supported third-party login (Google, Facebook, or Apple). One account per person; accounts are not transferable.

1.3 Account security. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@furs4sale.com of any unauthorized use.

1.4 Suspended users. If your account has been suspended or terminated, you may not use the Service or create a new account without our written permission.

2. Your dual buyer/seller role

A single account may be used to buy and to sell. The Seller Terms in Sections 7–11 and 19 apply whenever you list, offer, or sell an item. The buyer terms apply whenever you purchase. You are responsible for understanding which apply to your activity at any time.

3. The Service is a venue — we are not a party to your transactions

3.1 Neutral venue. Furs4Sale provides an online venue that connects independent buyers and sellers. Items listed on the Service are produced, owned, listed, fulfilled, and sold directly by independent sellers — not by Furs4Sale. We do not manufacture, store, inspect, take title to, or pre-screen any item.

3.2 Not a party. Each purchase is a contract directly between the buyer and the seller. Furs4Sale is not a party to that transaction and is not the buyer's or seller's agent.

3.3 No warranties about items. Because items are sold by independent sellers, Furs4Sale makes no warranties about the quality, safety, authenticity, legality, or fitness of any item. Any legal claim relating to an item — including defects, misrepresentation, or injury — must be brought directly against the seller.

3.4 Release. To the fullest extent permitted by law, you release Furs4Sale (and our officers, directors, employees, and agents) from any claims, demands, or damages arising out of or related to any item or any transaction with another user, including defective items, seller misrepresentations, non-delivery, and product-liability claims. (California residents: you waive California Civil Code §1542 to the extent applicable.)

4. Fees & commission

4.1 Commission. Listing is free. When a sale completes, Furs4Sale charges a commission of 10%, calculated on the item price only and never on shipping charges or taxes. The commission is deducted automatically from the seller's payout.

4.2 Changes. We may change our fees prospectively by posting updated terms and giving notice as described in Section 18. Changes do not apply to sales already completed.

5. Payments and Stripe Connect

5.1 Payment processing. Payments are processed by Stripe, Inc. Furs4Sale does not collect or store full payment-card numbers.

5.2 Seller onboarding. To receive payouts, sellers must create and maintain a Stripe Connect (Express) account, complete Stripe's identity verification, and provide a payout bank account. By onboarding, sellers separately agree to the Stripe Services Agreement and the Stripe Connected Account Agreement (collectively, the "Stripe Terms"), which govern the payment relationship. If there is a conflict between these Terms and the Stripe Terms with respect to payment processing, the Stripe Terms control as to that subject matter.

5.3 Flow of funds. At checkout the buyer pays the item price plus shipping. Furs4Sale deducts its 10% commission as an application fee and the remainder is transferred to the seller's connected Stripe account on Stripe's payout schedule.

5.4 Seller of record. Unless we state otherwise in writing, the seller is the seller and merchant of record for the goods it sells and is solely responsible for the sale, fulfillment, and any associated tax obligations.

5.5 Taxes. Each user is responsible for determining and paying its own taxes. Where required by law, Furs4Sale or Stripe may collect and remit certain taxes, issue tax forms (e.g., Form 1099-K), or act as a marketplace facilitator.

6. Buyer terms

6.1 You agree to pay the full amount due at checkout and to provide accurate shipping information.

6.2 You understand that returns, refunds, and cancellations are handled under Section 11 and that the seller — not Furs4Sale — is responsible for the item.

7. Seller terms — listings & obligations

As a seller, you represent, warrant, and agree that:

7.1 Accurate listings. Your listings are accurate and not misleading, including title, description, photos, condition, price, shipping cost, and quantity.

7.2 Right to sell. You own or are authorized to sell each item and to grant the content license in Section 14.

7.3 Legal compliance. Your items and your conduct comply with all applicable local, state, federal, and international laws and regulations, and with our Prohibited & Restricted Items policy (Section 8).

7.4 Fulfillment. You will ship sold items promptly, provide valid tracking where available, and honor your listed price and shipping terms.

7.5 Stripe good standing. You will maintain a Stripe Connect account in good standing.

8. Prohibited & restricted items

8.1 General prohibitions. You may not list or sell: illegal goods or services; stolen property; weapons or regulated items you are not licensed to sell; recalled, hazardous, or unsafe goods; counterfeit or IP-infringing items; or anything that violates these Terms or applicable law.

8.2 Animal products & furs — special rules. Because Furs4Sale facilitates the sale of animal furs, sellers of fur and animal products additionally agree that:

(a) No dog or cat fur. You will never list, sell, advertise, trade, transport, or distribute any product made in whole or part with dog or cat fur. This is categorically prohibited (19 U.S.C. §1308).

(b) No protected species. You will not list fur or parts from endangered or threatened species, species protected under the Endangered Species Act or CITES, or marine mammals (e.g., seal) unless you hold and can document all required legal authority. You acknowledge that an animal appearing in the FTC Fur Products Name Guide does not mean its fur is legal to sell.

(c) FTC Fur Products Labeling Act compliance. For each fur product, your listing and any invoice will disclose, as required by the FPLA and 16 CFR Part 301: the animal species name (per the FTC Fur Products Name Guide); the country of origin of imported fur (stated as "Fur Origin: [country]"); whether the fur is pointed, dyed, bleached, or artificially colored; whether the fur is used or damaged; and your name or FTC Registered Identification Number (RN).

(d) Lawful sourcing. Your fur is lawfully sourced and not taken, possessed, transported, or sold in violation of the Lacey Act or any wildlife law.

(e) Geographic restrictions. You will not sell or ship fur products into any jurisdiction that prohibits their sale. You may not sell or ship fur products into California or any other jurisdiction we designate as restricted.

(f) Cross-border (US↔Canada). For shipments crossing the US–Canada border, you are responsible for all import/export and CITES permitting and customs compliance.

8.3 Enforcement. We may remove any listing and suspend any account that we believe violates this Section, without prior notice, consistent with Section 13.

9. Reviews, ratings & user content

9.1 Buyers may rate and review a seller after an order is delivered. Reviews must be honest, based on a genuine transaction, and free of unlawful, defamatory, harassing, or private personal information.

9.2 You may not manipulate reviews, offer incentives for reviews, or post fake reviews.

9.3 We may moderate, refuse, or remove content that violates these Terms.

10. Messaging & communications

On-platform messaging is for legitimate transaction and support purposes. You may not use it to spam, harass, solicit off-platform transactions to evade fees, or distribute malware. We may monitor messaging for safety, fraud-prevention, and policy enforcement.

11. Returns, refunds, cancellations & disputes

11.1 Refunds. Sellers set their return/refund terms within any minimum standards we publish. Sellers may issue refunds; buyers may submit refund requests, which Furs4Sale may mediate at its discretion.

11.2 Chargebacks. If a buyer initiates a payment dispute or chargeback, the seller is responsible for the disputed amount and any associated fees. You authorize Furs4Sale and Stripe to debit the seller's Stripe balance or offset future payouts to recover refunded or charged-back amounts and related costs.

11.3 Our role. Furs4Sale is not responsible for issuing refunds for items and acts only as a facilitator and, where it chooses, a mediator.

12. Acceptable use / prohibited conduct

You agree not to: use the Service for any unlawful purpose or in violation of any law or regulation; infringe others' rights; engage in fraud or deceptive practices; circumvent fees; scrape, reverse-engineer, or overload the Service; upload malware; impersonate others; or create accounts by automated means.

13. Suspension, termination & appeals

13.1 Our rights. We may suspend or terminate your access, remove content, or limit features if we reasonably believe you have violated these Terms or applicable law, or to protect the Service or its users.

13.2 Seller suspension & appeal. If we suspend a seller account, we will provide notice of the reason where practicable, and the seller may submit an appeal through the in-app appeal process. We will review timely appeals in good faith.

13.3 Effect. On termination, your right to use the Service ends. Sections that by their nature should survive (including 3, 4, 5, 14, 15, 16, 17) survive termination. Pending orders and payouts will be handled as we reasonably determine and as the Stripe Terms require.

14. Intellectual property

14.1 Our IP. The Service, including its software, design, and the Furs4Sale name and logos, is owned by Furs4Sale or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service per these Terms.

14.2 Your content. You retain ownership of the content you submit (listing photos, text, reviews, messages — "Your Content"). Furs4Sale does not claim ownership of Your Content. You grant Furs4Sale a non-exclusive, worldwide, royalty-free, transferable, sub-licensable, perpetual, irrevocable license to use, host, store, display, reproduce, modify (for formatting/display), distribute, and prepare derivative works of Your Content for operating, promoting, and improving the Service. You represent that you have all rights necessary to grant this license.

15. DMCA / copyright

If you believe content on the Service infringes your copyright, send a notice with the elements required by 17 U.S.C. §512(c)(3) to our designated agent at dmca@furs4sale.com; Designated Agent: Brian Sokoloski, TJB Partners LLC, 858 140th Ave, Fairmont, MN 56031-1338, USA. We will respond to valid notices, provide a counter-notice procedure, and terminate repeat infringers.

16. Disclaimers & limitation of liability

16.1 AS IS. THE SERVICE AND ALL ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

16.2 No liability for items/users. Furs4Sale is not liable for the acts or omissions of any user, the condition or legality of any item, or any transaction between users.

16.3 Limitation. TO THE FULLEST EXTENT PERMITTED BY LAW, FURS4SALE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID US IN THE six (6) MONTHS BEFORE THE EVENT, OR (B) US$100.

16.4 Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent permitted.

17. Dispute resolution — arbitration & class-action waiver

17.1 Informal resolution first. Before filing a claim, you and we agree to try to resolve the dispute informally by contacting legal@furs4sale.com; allow 60 days.

17.2 Binding arbitration. If not resolved, you and Furs4Sale agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as in 17.5.

17.3 Class-action waiver. Disputes will be arbitrated only on an individual basis; class, collective, and representative actions are waived.

17.4 Governing law & venue. These Terms are governed by the laws of the State of Minnesota and applicable U.S. federal law (including the Federal Arbitration Act), without regard to conflict-of-laws rules. For any claim not subject to arbitration, the exclusive venue is the state and federal courts located in Martin County, Minnesota, and you consent to their jurisdiction.

17.5 Exceptions. Either party may bring an individual claim in small-claims court or seek injunctive relief for IP misuse.

17.6 30-day opt-out. You may opt out of this Section 17 by emailing arbitration-optout@furs4sale.com within 30 days of first accepting these Terms, stating your name and account email. Opting out does not affect any other part of these Terms.

17.7 Canadian users. If you are a resident of Canada, you may instead bring non-arbitrable claims in, and have them governed by the laws of, the courts of your province of residence (for example, Ontario or Quebec), and nothing in this Section limits any non-waivable rights or remedies available to you under the law of your province.

18. Changes to these Terms

We may update these Terms. For material changes we will post the updated Terms with a new "Last updated" date and provide reasonable notice (e.g., by email or in-app). Continued use after the effective date constitutes acceptance.

19. General

19.1 Assignment. You may not assign these Terms; we may assign them to an affiliate or successor. 19.2 Severability. If any provision is unenforceable, the rest remains in effect. 19.3 No waiver. Our failure to enforce a provision is not a waiver. 19.4 Force majeure. Neither party is liable for delays caused by events beyond its reasonable control. 19.5 Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. 19.6 Contact. TJB Partners LLC, 858 140th Ave, Fairmont, MN 56031-1338, USA, legal@furs4sale.com.
